Road Traffic Accidents Whilst On Duty

CWU Legal Services Department have recently dealt with an inquiry, where a member was involved in a road traffic accident whilst driving a company vehicle on duty.

The incident was subsequently reported to the employer. However, the employer then wrote to the member, indicating that there was a legal responsibility for him to report the accident to his own insurance company, irrespective of the accident being covered on the company insurance policy.

On taking legal advice, Tony Rupa, CWU Legal Services Officer, has been informed that the employers request is in order and in that any person who is involved in a road traffic accident, irrespective of the circumstances, is duty bound to report the details to their own insurance company and if they fail to do so then they are in breach of their insurance policy and acting fraudulently.
